1. Scope

These Terms of Service apply to the use of the website sbotify.com and the services offered thereon by SBotify, represented by Thomas Schärer, Ebentaler Straße 100A, 9020 Klagenfurt, Austria.

By registering and using our services, you accept these Terms of Service in full.

2. Service Description

SBotify provides a platform for creating and embedding AI-powered chatbots for websites. Our services include:

• Chatbot creation and configuration
• Website scanning for knowledge extraction
• Integration of various AI providers (OpenAI, Claude, Gemini)
• Embedding code for websites
• Analytics and usage statistics

3. Contract Formation

The contract is formed through:

1. Registration on our platform
2. Confirmation of registration by email
3. For paid plans: Selection of plan and successful payment

4. Pricing and Payment Terms

4.1 Free Version

The free version includes:

• 1 chatbot for 1 domain
• Up to 50 pages per domain
• 500 messages per month
• Visible notice: "This chatbot was created with Sbotify.com"

4.2 Paid Version

The paid version includes:

• Up to 3 chatbots for 3 domains
• Unlimited pages per domain
• Unlimited messages
• No SBotify branding
• Priority support

4.3 Payment

Payment is processed through Stripe. The General Terms and Conditions of Stripe apply. Billing occurs in advance for the selected period.

4.4 Cancellation

The subscription can be canceled at any time until the end of the current billing period. Refunds for amounts already paid are excluded.

5. Usage Rights

By creating a chatbot, we grant you a non-exclusive, non-transferable right to use the created software. All rights to the platform remain with SBotify.

6. User Obligations

The user agrees to:

• Provide truthful information during registration
• Keep access credentials secure
• Not misuse the services
• Not distribute illegal or unlawful content through the chatbots
• Comply with applicable laws, especially GDPR
• Provide own API keys for AI services

7. Availability and Disruptions

We strive for the highest possible availability of our services but cannot guarantee 100% availability. Short-term interruptions may be necessary for maintenance work.

8. Liability

8.1 Limitation of Liability

SBotify is liable only for intent and gross negligence. Liability for slight negligence is excluded unless:

• Breach of essential contractual obligations
• Bodily injury
• Assumption of guarantee
• Application of product liability law

8.2 Scope of Liability

Liability is limited to foreseeable, typically occurring damages. Liability for indirect damages, lost profits, or data loss is excluded.

9. Data Protection

The collection and processing of personal data is carried out in accordance with our Privacy Policy and applicable data protection laws.

10. Intellectual Property

All rights to the platform, design, code, and content remain with SBotify. Reproduction, distribution, or public display without express consent is prohibited.

11. Termination

The usage relationship can be terminated by either party at any time without giving reasons. In case of violation of these Terms of Service, we reserve the right to suspend or delete the account without prior notice.

12. Severability Clause

Should individual provisions of these Terms of Service be or become invalid, the contract shall otherwise remain valid. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose.

13. Applicable Law and Jurisdiction

These Terms of Service are subject to Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is Klagenfurt am Wörthersee, Austria.

14. Changes to Terms of Service

We reserve the right to change these Terms of Service at any time. Changes become effective upon publication on this page. For significant changes, we will notify you by email.
